Woman sues airline for £5 million - because her in-flight TV wasn't working

Cary David says she will share the money with fellow passengers who have also missed out on watching TV while flying with US carrier United Airlines.

Cary David, from Orange County, New Jersey filed the claim against United Airlines after paying for four hours of television but only receiving a signal in the final 10 minutes of her journey.

She claims the airline failed to “disclose that the services will not work as advertised when the aircraft is outside the continental United States or is over water.”

And if she wins she says the money should be split among other airline passengers who have suffered the same problem.

The lawsuit against United Continental Holdings Inc alleges that she paid $7.99 for in-flight DirecTV on her February 21 return passage from Puerto Rico, reports travel advice website Road Warrior Voices.
The amount should have covered the cost of her in-flight entertainment for the entire journey.

But the TV failed to work and only kicked into action in the final moments of her flight meaning she paid the equivalent of $0.80 per minute to watch live shows.

The suit states: "All consumers who purchased DirecTV service or WiFi service on a DirecTV equipped plane from January 1, 2012 through and including the date a judgment is entered in this action, for a flight that flew outside of the continental United States or over water.”

It is not yet clear if any other passengers have joined her action.

United Continental Holdings has filed a bid to dismiss the suit entirely.

In a statement to Road Warrior Voices, a spokesman for the airline said: “We believe this suit is without merit both factually and legally.

"On our DirecTV-equipped planes, we clearly inform our passengers in writing on the screen before they confirm their purchase that ‘Live DIRECTV programming is not available while the aircraft is outside of the continental United States’ and that ‘Wi-Fi service is available over the continental US."
